Outlines Policy on Immigration Benefits for Aliens with DUI or DWI
History
A USCIS memo reveals the department's focus
on a provision that allows for reexaminations of aliens who have
as few as one drunk driving offense. Under the policy, aliens
with such a record who hadn't previously been examined in terms
of the drunk driving offense could be slated for a reexamination
by a civil surgeon. Under USCIS guidelines, drunk driving offenses
can potentially qualify someone as having a mental disorder, thus
making them ineligible for whatever immigration benefits they
sought.
